Differences between expert appraisal and mortgage appraisal

Regulatory framework, purpose and scope of the expert appraisal compared to the mortgage appraisal under ECO Order 805/2003.

It is common to confuse a mortgage appraisal with an expert appraisal. Both assign a value to a property, but they serve different purposes, are governed by different frameworks and are not interchangeable. Choosing the appropriate one depends on the use to which the report will be given.

Mortgage appraisal

The mortgage appraisal is what financial institutions use to grant a loan with a mortgage guarantee. It is regulated by ECO Order 805/2003 and its amendments, and must be issued by an appraisal company approved by the Bank of Spain or a professional authorized under that framework.

Features

  • Purpose: mortgage guarantee of a loan.
  • Methodology limited by regulations.
  • Standardized format and content.
  • Usually valid for six months.
  • Issued by an approved appraisal company.

Expert appraisal

The expert appraisal is an independent technical report that values a property for a specific use: inheritance distribution, property settlement, purchase and sale, contribution in court, negotiation or support of a property decision.

Features

  • Purpose defined by the case.
  • Methodology adjusted to use and market.
  • Format adapted to the usefulness of the report.
  • Not subject to ECO Order 805/2003.
  • Issued by an expert with the corresponding qualifications and membership.

Practical comparison

When to use each one

  • If you need bank financing with a mortgage: mortgage appraisal.
  • If you need to distribute an inheritance: expert appraisal.
  • If you need to provide value in a trial: expert appraisal.
  • If you need to support a sale between individuals: expert appraisal.
  • If the bank requires an official appraisal for your credit: mortgage appraisal.

What happens if they get confused

An expert appraisal is not generally useful for granting a mortgage loan. A mortgage appraisal can be used for other purposes, but its format and purpose are not always the most appropriate for negotiating, litigating or distributing.

Matches

Both reports require a visit, documentary verification, application of reasoned methodology and technical signature. Both must be defensible before third parties. The difference is in the framework and purpose, not in rigor.

Prudence

If your case combines bank financing and litigation, or if you have doubts about which report fits, it is worth discussing this before commissioning any assessment to avoid duplicating work and expense.
