Assessment of the case and expert feasibility
What does the initial assessment of the case consist of, how its expert feasibility is analyzed and when it is appropriate or not to commission a report.
Not all matters require an expert report, and not all that do provide real value to the procedure. Before issuing a quotation, a prior analysis is carried out to assess whether it makes sense to intervene and to what extent.
What is analyzed in the assessment
The initial assessment is not a ruling or a definitive opinion. It is a technical filter that helps decide whether to advance towards a complete expert report.
Nature of the matter
It is studied whether the events described fall within the expert scope: material damage, building defects, losses, assessments, accident reconstruction. If the matter is purely legal or lacks a technical component, we will indicate this clearly.
Fit into a specialty
Each case must fit into a specific specialty. You can consult the full list of specialties and help center sections such as hidden defects or defective workmanship.
Documentation available
It reviews what documents, photographs or previous reports exist. Sometimes, with the documentation provided, it is already possible to anticipate whether the expert intervention will be useful or whether it will be necessary to gather more information.
Procedural moment
It is not the same to intervene before a claim as it is in the middle of the court proceedings. In both cases there is room for action, but the focus changes.
When expert report provides value
an expert report is especially useful when:
- There are technical facts that must be objectively proven.
- There is a discrepancy with a insurer, promoter or third party.
- A court proceedings is foreseen in which technical evidence weighs.
- A well-founded economic assessment of damage or property is needed.
- Reconstruction of an accident or loss is required to determine causes.
When it may not be necessary
In some cases, after the initial assessment, it is recommended not to commission a report:
- The matter is small and the cost of the report is not proportionate.
- The facts are already proven by other sufficient means.
- The problem is exclusively legal and must be addressed through legal advice.
- There is no technical basis to support the claim raised.
In these cases we will communicate it to you transparently. Honesty in this phase is part of the job.
Coordination with lawyer
If your matter is in the hands of a lawyer, it is common to coordinate the assessment with him, especially when the evidentiary approach must be decided. Expert work complements the legal strategy, it does not replace it.
Next steps
If the assessment concludes that it is appropriate to intervene, the next step is the preparation of the quotation and formalization of the order. If you have questions about the approach, you can write from the contact page.
