Documentation required before the expert visit
Documentation for a defective workmanship report
What documents to gather in a defective workmanship or building defects case: project, contract, qualities, minutes and communications.
In a claim for defective workmanship or building defects, prior documentation makes the difference between a generic report and a report that can be sustained before the counterparty or before a court. The objective is to trace what was contracted, what was actually executed and what defects the result presents. Legal questions about warranty periods or claim methods correspond to the lawyer.
Contractual and project documentation
Contract with the construction or promoter company
It is the base document. Includes scope of work, price, deadlines and conditions. If there were subsequent modifications, also provide the annexes.
Technical project
If there is a project drawn up by an architect or engineer (new construction, renovation with license, extension), it is advisable to have:
- Descriptive memory.
- Renovated state plans.
- Specification.
- quotation by items.
Quality memory
In new construction by a developer, the quality report delivered to the buyer is essential to compare what was promised with what was executed.
Urban planning licenses
- Construction license.
- First occupancy license or occupancy certificate if applicable.
Execution documentation
Layout, construction and reception minutes
When they exist, the minutes record progress and delivery. They are especially useful for tracing when defects appeared.
Work certifications and invoices
- Partial certifications issued during execution.
- Contractor invoices.
- Supply invoices if the client provided materials.
Final work certificate
In new construction, the final certificate signed by the project management is part of the technical documentation.
Communications with the construction company or promoter
Any communication in which defects have been revealed:
- Burofax with acknowledgment of receipt.
- Emails.
- Certified letters.
- Notarial records if they exist.
These communications help set dates and prove that the responsible party was aware of the problem.
Photos and videos
- Images of the work process if there were any.
- Photographs of the current state and evolution of the pathologies.
- Videos that show dynamic defects (active damp, evolving cracks).
Good practices in the photo and video guide.
Budgets and previous reports
- Repair estimates requested from third parties.
- Previous technical reports if they exist.
- Expert reports from the insurer of the promoter or builder if they have been issued.
Procedural data
If there is an appointed attorney or ongoing proceedings:
- Information about the lawyer and the attorney.
- Previous writings and responses.
- Court reference.
Next steps
- Please refer to general process.
- Review the general documentation guide.
- discuss your case from the help form or the contact page.
